The Federal High court Chief Judge, Justice Tsoho John has directed that the case file in Mazi Nnamdi Kanu's treason trial should be returned to Justice Nyako Binta to continue hearing the case.
Justice Nyako had earlier, exempted herself from the case on September 24, 2024. After Nnamdi Kanu the leader of the Ipob, demanded that she hands off the case, claiming that he doubts the Judge's ability to ensure fair hearing.
Justice Tsoho who directed that Justice Nyako continues presiding over the case while Nnamdi Kanu files a formal application, supported with an affidavit, and also providing details why his case should be conducted by a different Judge.
By the conditions of Justice Tsoho, the prosecution is also required to respond to Kanu's application, following which justice Nyako will hear the application and give a ruling, deciding whether she continues or not.
The condition, which was to prevent a repeat of what had happened in the past in the money laundering case which was linked with former Governor of Benue state, Gabriel Suswam, in which the court of appeal overruled justice Mohammed Ahmed, who had withdrawn from the case.
The withdrawal of Nnamdi Kanu's Judge would have been the the third time a Judge would be abandoning a case at the request of a defendant.
